Techtonic Systems Media and Research LLC operates as a channel partner of DNS Stack Private Limited for the distribution and sale of Utility-Server, a software product owned and developed by DNS Stack Private Limited.

3. Legal Jurisdiction & Responsibility

3.1 Governing Law and Legal Jurisdiction

IMPORTANT NOTICE: All legal matters, disputes, claims, proceedings, and liability related to:

Techtonic Systems Media and Research LLC
Utility-Server product and services
Any business operations conducted through Techtonic Systems Media and Research LLC
Customer agreements, transactions, and disputes

Shall be exclusively governed by the laws of India and handled by DNS Stack Private Limited in India.

3.2 Legal Responsibility

DNS Stack Private Limited (parent company, India) assumes full legal responsibility for:

All business operations of Techtonic Systems Media and Research LLC
All customer disputes and legal claims
Product liability and service warranties
Contractual obligations and agreements
Intellectual property matters
Data protection and privacy compliance

3.3 Dispute Resolution

All disputes arising from or relating to services provided through Techtonic Systems Media and Research LLC shall be:

Subject to the exclusive jurisdiction of courts in India
Resolved in accordance with Indian laws
Handled directly by DNS Stack Private Limited

No legal proceedings shall be initiated against Techtonic Systems Media and Research LLC in the United States or any other jurisdiction. All claims must be directed to DNS Stack Private Limited in India.

4. United States Compliance

4.1 US Business Operations

Techtonic Systems Media and Research LLC operates as a Limited Liability Company under Wyoming state law and complies with:

Wyoming LLC Act
Federal business regulations applicable to LLCs
US tax laws and reporting requirements
State and federal commercial laws

4.2 Channel Partner Status

As a channel partner, Techtonic Systems Media and Research LLC:

Distributes Utility-Server on behalf of DNS Stack Private Limited
Does not own intellectual property rights to Utility-Server
Acts as a sales and distribution channel only
Refers all technical, legal, and customer service matters to DNS Stack Private Limited

4.3 Limited Liability

Techtonic Systems Media and Research LLC operates with the limited liability protections afforded to LLCs under Wyoming law. All substantive legal matters are handled by the parent company in India as specified in Section 3.

5.1 Data Processing

Utility-Server processes only publicly available data with explicit user consent. When serving EU customers:

User consent is obtained before data processing
Users retain control over their data
Data processing is limited to the scope of user authorization
No personal data is stored without explicit consent

For EU users and data subjects:

Utility-Server processes data as a data processor under user instruction
Users act as data controllers for their own operations
DNS Stack Private Limited maintains data processing agreements where required
Users are responsible for compliance with GDPR for their own data processing activities

5.3 Data Subject Rights

EU data subjects may exercise their rights (access, rectification, erasure, restriction, portability, objection) by contacting DNS Stack Private Limited in India.

6. International Operations & Global Compliance

6.1 Global Service Delivery

Utility-Server is available to users worldwide. For international operations:

Services are provided from infrastructure located globally
Data processing occurs in accordance with user preferences
International data transfers comply with applicable frameworks
Users in specific jurisdictions must comply with local laws

6.2 Multi-Jurisdictional Framework

For users outside the United States and European Union:

Services are governed by the terms and policies of DNS Stack Private Limited
Local laws and regulations may apply to user operations
Users are responsible for ensuring compliance with their local jurisdiction
All legal disputes are resolved in India under Indian law (as per Section 3)

6.3 Export Controls

Users must comply with applicable export control and sanctions laws when using Utility-Server, including:

US export control regulations
EU export restrictions
International sanctions regimes
Local import/export laws in user jurisdictions

7. Product & Service Information

7.1 Utility-Server

Utility-Server is a software product developed, owned, and maintained by DNS Stack Private Limited. All technical specifications, documentation, and support are provided by DNS Stack.

7.2 Terms of Service

By using services through Techtonic Systems Media and Research LLC, users automatically agree to:

All these documents are maintained by DNS Stack Private Limited and apply to all Utility-Server users globally.

8. Payment Processing & Financial Disclaimers

8.1 Payment Gateway

Utility-Server does not process, store, or handle payment information directly. All payment transactions are processed through third-party payment gateways that comply with:

PCI DSS (Payment Card Industry Data Security Standard)
Relevant financial regulations in applicable jurisdictions
Secure payment processing standards

8.2 Financial Responsibility

DNS Stack Private Limited is responsible for all financial matters, including:

Payment gateway integration and compliance
Transaction processing and disputes
Refunds and billing issues
Tax compliance and reporting

9. White-Label & Channel Partners

9.1 Channel Partner Network

Techtonic Systems Media and Research LLC is one of several channel partners authorized to distribute Utility-Server. DNS Stack Private Limited may work with other channel partners and white-label arrangements.

9.2 Channel Partner Disclaimer

Techtonic Systems Media and Research LLC (and other channel partners):

Are not responsible for end-client processes, data handling, or usage of Utility-Server
Act solely as distribution channels
Do not assume liability for client implementations or outcomes
Refer all technical and legal matters to DNS Stack Private Limited

9.3 White-Label Solutions

When Utility-Server is provided as a white-label solution:

The white-label partner is responsible for their own client relationships
DNS Stack Private Limited provides the underlying technology
Legal compliance and client disputes remain with DNS Stack in India
Channel partners facilitate sales but do not assume product liability

10. Intellectual Property

10.1 Ownership

All intellectual property rights in Utility-Server, including but not limited to:

Software code and architecture
Documentation and technical materials
Trademarks and brand assets
Patents and trade secrets

Are owned exclusively by DNS Stack Private Limited.

10.2 License

Techtonic Systems Media and Research LLC operates under a license agreement with DNS Stack Private Limited to distribute and sell Utility-Server as a channel partner.

11. Limitation of Liability

11.1 Service Disclaimer

Utility-Server is provided “AS IS” without warranties of any kind. To the fullest extent permitted by law:

No warranties are provided regarding uptime, performance, or results
DNS Stack Private Limited is not liable for consequential or indirect damages
Liability is limited as specified in the Terms and Conditions

11.2 Liability Cap

Maximum liability under any circumstances is limited to the amount paid by the user for services in the preceding 12 months, as determined by DNS Stack Private Limited under Indian law.

12. Privacy & Data Security

12.1 Privacy Policy

Data handling practices are governed by the Privacy Policy maintained by DNS Stack Private Limited.

12.2 Data Security

Utility-Server implements industry-standard security measures. However:

Users are responsible for securing their own accounts and credentials
Users control what data they choose to process through Utility-Server
DNS Stack is not responsible for data breaches resulting from user negligence

13. Modifications & Updates

13.1 Document Updates

DNS Stack Private Limited reserves the right to update this legal information and all related documents at any time. Updates will be effective immediately upon posting with a revised “Last Updated” date.

13.2 User Notification

Material changes will be communicated through:

Email notifications to registered users
In-app notifications within Utility-Server
Website announcements on dnsstack.com and techtonic.systems

Continued use of services constitutes acceptance of updated terms.

If any provision of this document is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15.2 Entire Agreement

This document, together with the Terms and Conditions, Privacy Policy, Disclaimer, SLA, and NDA, constitutes the entire agreement between users and DNS Stack Private Limited regarding Utility-Server.

16. Acknowledgment & Automatic Agreement

BY ACCESSING, USING, OR PURCHASING UTILITY-SERVER THROUGH TECHTONIC SYSTEMS MEDIA AND RESEARCH LLC OR ANY OTHER CHANNEL, YOU AUTOMATICALLY ACKNOWLEDGE AND AGREE TO:

All terms and conditions set forth in this document
The jurisdiction and legal responsibility framework (Section 3)
That all legal matters will be handled exclusively in India
All related legal documents (Terms, Privacy Policy, Disclaimer, SLA, NDA)
DNS Stack Private Limited’s role as the legal entity responsible for all aspects of Utility-Server

NO SEPARATE SIGNATURE OR EXPLICIT ACCEPTANCE IS REQUIRED. USE OF SERVICES CONSTITUTES BINDING ACCEPTANCE.
